1. Acceptance of terms
By using the tothetopnow app, you agree to these Terms of Service.
2. The service
tothetopnow is a fitness application that tracks elevation progress towards a Mount Everest goal. The service is provided by Kurs AS.
3. Mandatory Strava account
To use the app, you must connect and maintain a valid Strava account. You authorize the app to access your Strava activity data needed to provide the service.
4. User accounts
You are responsible for maintaining your account and the connection to your Strava account.
5. Purchases
The app offers a one-time in-app purchase to unlock the Everest challenge. All payments are handled by Apple App Store or Google Play.
6. License to use the app
You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.
7. Acceptable use
You may not misuse the app, attempt to access backend systems, or interfere with the service.
8. Health and fitness disclaimer
The app is provided for general fitness and motivational purposes only and does not constitute medical advice.
9. Availability
We do not guarantee uninterrupted availability of the service.
10. Termination
We may suspend or terminate access if you violate these terms.
11. Limitation of liability
The service is provided “as is”. To the maximum extent permitted by law, Kurs AS is not liable for indirect or consequential damages.
12. Governing law
These terms are governed by the laws of Norway.
